These Terms of Service (“Terms”) govern your access to and use of erateapp.com (the “Site”) and the E-Rate consulting services (the “Services”) provided by SkyRate LLC, operating as erateapp (“erateapp,” “we,” “us,” or “our”). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By accessing the Site, submitting a form, or engaging our Services, you represent that you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the organization you represent.

2. Description of Services

erateapp provides consulting and advisory services related to the federal E-Rate program, including assistance with Form 470 and Form 471 filing, PIA review support, appeals, compliance monitoring, and related guidance for schools, charter schools, and libraries. Information on the Site is provided for general informational purposes and does not constitute legal, financial, or professional advice.

3. No Affiliation with USAC or the FCC

erateapp is an independent consulting firm. We are not affiliated with, endorsed by, or sponsored by the Universal Service Administrative Company (USAC), the Federal Communications Commission (FCC), or any government agency. Program rules and outcomes are ultimately determined by USAC and the FCC.

4. No Guarantee of Outcomes

While we apply our expertise to help maximize your chances of a successful E-Rate application, funding decisions are made solely by USAC. We do not guarantee any specific funding amount, approval, or outcome.

6. Fees & Payment

Fees for paid Services, if any, will be described in a separate agreement, proposal, or invoice. Unless otherwise stated, invoices are due upon receipt. You are responsible for all applicable taxes.

7. Intellectual Property

The Site, its content, logos, and materials are owned by SkyRate LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our content without prior written permission, except as reasonably necessary to use the Services.

8. Third-Party Links & Services

The Site may reference or link to third-party websites and services, including USAC, the FCC, and SkyRate AI. We are not responsible for the content, policies, or practices of any third party.

9. Disclaimer of Warranties

The Site and Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, SkyRate LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost funding, profits, or data, arising out of or related to your use of the Site or Services. Our total aggregate liability will not exceed the amount you paid to us for the Services giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless SkyRate LLC from any claims, damages, liabilities, and expenses arising from your use of the Site or Services or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law provisions. Any dispute will be resolved in the state or federal courts located in Wyoming.

13. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted, and the “Last updated” date above reflects the latest revision. Your continued use of the Site constitutes acceptance of the updated Terms.
